Both officers responded to the report of a man, Brooks, who was sleeping in his car at a drive-thru lane. In videos that have circulated online, Brooks can be seen calmly speaking with officers and taking a breathalyzer test. The officers attempted to arrest Brooks on suspicion of drunken driving leading to the trio of men wrestling on the ground, Brooks grabbing one of the officer’s taser and attempting to flee. The footage shows Brooks pointing the Taser over his shoulder leading to Rolfe shooting him in the back multiple times leading to Rolfe’s death.

According to 11 Alive News, Rolfe kicked Brooks while he was on the ground and Brosman stood on Brooks’ shoulder. Prosecutors reviewed eight videos from the shooting. Rolfe was also heard stating “I got him” after shooting Brooks.

“Mr. Brooks never presented himself as a threat,” Howard said.

Howard also revealed that the taser was shot twice and not dangerous once it was in Brooks’s possession, which Rolfe knew. Brosnan has cooperated with the investigation and given testimony.

Rolfe’s records also stated he recently completed de-escalation training and cultural awareness training as recent as this past April.
